Understanding FTCA Deadlines

Administrative Claim Deadline (SF-95)

Under the Federal Tort Claims Act (28 U.S.C. § 2401(b)), you must file your Standard Form 95 (SF-95) administrative claim within 2 years of when your claim accrues. The claim accrues when you discover (or should have discovered) the injury and its cause.

Lawsuit Filing Deadline

If your administrative claim is denied or the agency fails to respond within 6 months, you have 6 months from the denial date to file a lawsuit in federal court.

Wrongful Death Exception

In wrongful death cases where the original incident was outside the statute of limitations, the date of death may reset the accrual date. This is a complex legal issue that requires careful analysis by an experienced FTCA attorney.
